The MSH Capital Advisors LLC policy establishes procedures for the receipt, review, and retention of complaints relating to illegal activity(ies) and/or violations of MSH Capital Advisors LLC's (“the Firm”) written policies and procedures, including the Code of Ethics. The Firm is committed to complying with all applicable accounting standards, accounting controls, and audit practices. While the Firm does not encourage frivolous complaints, the Firm does expect its officers, Associated Persons (“AP”), and agents to report any irregularities and other suspected wrongdoing regarding questionable accounting, auditing, operational, compliance or personal conduct matters. It is the Firm’s policy that its APs may submit complaints of such information on a confidential and anonymous basis without fear of dismissal or retaliation of any kind. Rule 606 requires broker-dealers that route customer orders in equities and option securities to publish quarterly reports that provide a general overview of their routing practices. MSH Capital Advisors LLC (SMHCAroutes all option orders to our clearing firm, Pershing, LLC (Pershing). MSH does not route to any destinations directly, nor does MSH receive any compensation for directing option order flow to Pershing. Pershing selects the broker-dealer for option execution and may receive compensation for directing such orders.
MSH routes all equity orders through our clearing firm, Pershing, LLC (Pershing), or Bank of America Merrill Lynch/BofA Securities Incorporated (BAML) to market centers, which include national securities exchanges, alternative trading systems, electronic communications networks, and broker-dealers. These firms may receive compensation or other consideration (payment for order flow) for directing such orders to particular broker-dealers or market centers for execution.
MSH does not receive compensation for routing order flow to Pershing or BAML. MSH has an agreement with Pershing and an agreement with BAML which includes an execution fee to route orders. In addition, MSH is charged an execution fee or rebated in accordance with the national securities exchanges published rates. Fees and rebates are non-negotiable, set by the national securities exchanges, and may contain tiers based on volume thresholds. Sometimes, the credits or rebates offered by a market center may exceed the charges assessed.
